???Conciliation

Hello All!
I've had to go MIA for a week or so, but of course, I'm back with more questions on my custody mod.
I filed sort of incorrectly so I have to do it again. No waste of money, just time. Basically I have to decide if I should file for a judicial hearing or a conciliation. In conciliation (they can make decisions and recommend a final order to the judge and decide on the contempt at conciliation).
As some know, I have the eval. report pushing in support of my proposed order. But, should I just try to get it agreed to or decided at conciliation or just take it to the judge?

Conciliation would be similar to mediation. Since the evaluation is in your favor, odds are that the conciliation will also be in your favor. (Barring anything not considered by the evaluator or anything filed by X to challenge the evaluation, etc.)

The advantage is getting a second opinion in your favor...and settling the contempt issue without filing in court.

Personally, I'd do conciliation first and attempt to resolve the contempt issue.

I'm afraid conciliation will be a waste since ex so far doesn't think custody should change no matter what the eval. says, but hopefully they may help make it clear that it may be a waste of his $$$ to go to a hearing.
Between th eval. and contempt and the order I proposed that follows exactly what the evaluator recommended, you would think this could be handles at conciliation, but who knows with how he is.

Progress, Finally!

"Preacipe for Judicial Conciliation and Request for Trial" is what I filed.
I had motions court yesterday to get all my filing fees waived and the judge signed it!
She consolidated the contempt with the current modification and request based on evaluation being complete!
APRIL 27th IS THE BIG DAY!!!!!!!!!!!!!!!!!!
Not to far away!
Just waiting for a phone call from a Women's Advocacy I was recommended to by a court officer that said she definately thinks they can leaglly help me in the last leg of this long custody journey.
It's been over a year now since I filed to modify.
I'd LOVE to have representation for the hearing, otherwise, I think I'll need some Xanax...I shaked uncontrollably like a leaf and my voice quivers, all very noticably when it comes to these types of things.
I made a mistake and wore a ponytail last time and you could see it shaking.
Thank you so far for ALL the help!

Not one darn thing yet.
Maybe they are continuing the investigation or maybe they don't have enough evidence after all these years.
I haven't heard anything else from the detectives.

Funny thing is, the "truck" in questions has disappeard from their mothers home (where ex and his brother both reside), it's been gone for like 6 weeks now. Maybe they got the new "Failure to Launch" movie based on them, ones 27 the other 29 and still in Mommy's home.

Rmet, I did think of a question for you.
I've drawn up my proposed CO and re-raed, re-raed, and re-raed.
It's filed now of course, but I thought of something I forgot.
Am I able to get something in the CO about the hunting issues?

Maybe like, minor child is permitted NO exposue to firearms until it is age appropriate (12 yrs. old) to take the safety courses, and at that time, based on the child's maturity and responsibility levels, the safety courses may be taken if parents are in full agreement.

You can amend the order and since it is concilliation there may be an opportunity to bring it up later. It would be wise to not ban the activity all together as children are safer with safety training around guns than those never exposed so you may want to find out schedules from the local chapter of the NRA or Rod and Gun Club, shooting range re gun safety courses for children and use that as the template for the amendment.

Check with the detectives, perhaps the vehicle is impounded. Let them know there in a court date comming up where the investigation may impact the proceedings. Some issues could be moot. Is there a GAL, if so, are they aware of the investigation? Is the court aware?

***My fear is the is Dad being safe during this activity, btu I will definately check into your suggestions***

Never thought about impounding, good call. I'll definately give the detectives a buzz today***
