We have a small , 12 unit, property. For the first time we are having to deal with renters/vs. owner occupied units. We are in the process of revising our by-laws to address "new issues". Are the following legal in Louisiana?
1. All tenants living on the property must submit automobile license plate numbers, names of tenants in each unit, place of employment, emergency phone number.
2. Any unauthorized vehicle parked on property for a period of more than 24 hours will be towed at no notice and at owners expense.
3. Rentals must carry rental insurance. This insurance will be primary to the Association Insurance in case of claims.
4. Board members have to authority to inspect rental units with 24 hour notice to tenant, not owner.
5. Board must be notified of rental vacancies, and new residents.
6. Board will meet with all new tenants within 48 hours of occupancy of a unit to welcome to property and to present the by-laws, rules and regulations.
7. Property owners have first option of submitting requests for both rentals and purchases of available units.
If present owners comply with prices, etc., seller must sell to present owners.
8. If an owner's tenant does not comply with by-laws, owner can be made responsible for non-compliance. Our present by-laws have a "no fault" clause for the board members.
9. If a board member is in con-compliance with the by-laws, he/she, is also responsible and loses all previleges and stated in the by-laws.
10. What legal action can be taken in the event of concompliance with any of the by-laws?
11. Does an attorney have to file a lien against property, or can a citizen do this and file it? How does a lien work? Specifically, if a member does not pay monthly fees can we file a lien for each month that he is in non-compliance and how much do we file for and how is this paid?
