To summarize a long story, I had water damage to my condo through no fault of my own and was agreed to be paid for the damage by the condo association. But they keep making excuses now why they won't pay. I want to take them to court over the money but my two questions are
1. Who do I file the siut against?
2. What court do I use? ex. small claims court?

Have you had your problem discussed at an Association meeting? if so, then there is a record of their agreement to pay for the damages. If not, then get it on the agenda for their next meeting. If they change their mind, I would suggest that you speak to a local attorney about this. A simple"lawyer" letter to the association may get them to agree. Or call the county small claims court and talk to the advisor there. See if your case is appropriate and whether it falls within the dollar limits of the court. Good luck.
