Two months ago I received water damage in my condo due to a pipe break in another unit which was vacant (owner moved out and was trying to sell it). My HOA insurance hired a cleanup crew who were johnny on the spot in cleaning up the water but took two months to complete reconstruction of dry wall, etc. The investigation as to the cause took two months to complete and the outcome was that the empty unit had an open window and no heat...however, the units owner has no insurance and I am wanting reimbursed for the two months I had to live elsewhere, new carpet, and some clothing and electrical items I had damaged. My insurance company will pay for some of my claims but why should I have to submit to my insurance when I was the victim due to someone elses negilicience? I am at a loss as what to do next..small claims? civil lawsuit? I have never had to submit an insurance claim or been in this situation where the guilty party is uninsured. Do you have any suggestions? Thanks..
