What is the name of your state (only U.S. law)? Illilnois.

I live in a Condo.
The association has just been formed and is creating rules and regs.
There is a new proposed rule that states that you can not place flower boxes on the exterior or your balcony. They stated that the reason for this decission was a city code. I researched the code and it states that Flower boxes are fine on the exterior of a balcony as long as they are "secure".
They then said that the reason was because if the boxes fell and caused damage then the association would be liable for damage to people or property. I have spoken to my insurance company specificly about this issue and they said that my insurance policy would cover ANY damage to people or property. The association is still saying that if someone was to get hurt,they could come after the association too.
If someone is hurt, my insurance covers the damage, could they legaly come after the assocaition after my insurance pays them?What is the name of your state (only U.S. law)?

When someone is injured, they typically will go after ALL potentially liable parties. That includes the association. That means they would have to defend against the claim just like you, incurring costs. If they want to disallow the boxes for that reason, they can do so.
