My father had passed away about a year ago with AIDS. To my knowledge, I was told that I was the next of kin, and a beneficiary on my father's life insurance. After my father had passed away, my brother ( who was legally adopted by my father's parents) had pressured me into signing a Limited Power of Attorney, which stated that my brother would be my agent and handle anything to do with my father, it also stated that I was giving up my rights as a beneficiary, and all of my fathers estate, 401k, and retirement fund. :confused: I mistakenly signed the document before reading it, therefore, I decided to trust that my brother would do the right thing and include me in all of the decisions. But he did the opposite, he didn't contact me for about six months, but once he did call me to tell me that he had a lawyer saying that if my father had no Will, then my brother could pretend to find one in my father's belongings. He did just that, and took everything that my father owned without my approval. I revoked my Limited Power of Attorney , but regretfully, a little bit too late. What my brother has done is wrong, and he shouldn't be able to get away with this. I want to know if I can do something about this. I just want justice to be served. :mad:

To my knowledge, my father had an insurance plan of about 150,000.00, but I'm not for sure. And I know that his 401k plan was a couple thousand dollars. He also had 2 cars, a Corvette and a Camaro. And then he had alot of electronics and equiptment.

And also, I have no idea of what a probate attorney to contest is, can you explain to me what it is?

Do a google search for that, it will help you understand it.

The best "help" you are gong to get is this:
GO SEE AN ATTORNEY. This situation is too complicated, there is a Limited Power of Attorney involved and things that the members here cannot see.
