we found out in may of this year that me stepson had been sexually abusing my daughter. we carried her to a childrens advocacy center. the outcome was that it started when she was 4 and he was 12. the last time it happened she was 7 and he was 15. needless to say it went to the dept. of humans resources, then on to the district attorneys office. first let me say that the relationship between his mother and my husband (his father ) is not the best. She continues to refuse that he did anything wrong that it is just couriosity. The asst. district attorney handling our case made the suggestion that we offer a deal. The deal was that he get mandatory counceling and that he live with his maternal grandparents until couceling is completed. We agreed due to the fact that for the most part up until now we had not had any trouble with him. He was a well manered loving child. This to say the least shocked us. They accepted the offer to avoid prosecution. Now 7 months later we move out of the county and we find out from various sources that he is not living with his grandparents and that he is getting into a lot of trouble. he has wrecked his car twice, his stepdads truck and is getting speeding tickets. one of them was for 85mph. He even had the law called on him because he was at a minor girls house at 2am and the father caught him but did not press charges. My concern is that the da promised me that we would prosecute if he broke any of the terms of the agreement but there is no way to prove that he has moved back home. He has basically gone wild and having fun while my daughter is still suffering. I need to know is there a personal lawsuit I could file against him for pain and suffering or no because he is a juvenile. second, The da tells me that due to the age of the children she is not sure he could be prosecuted. This is hard for me to believe. The da is a very nice person, but I have to beleive that there is something I can do to make him pay. He is just going to end up hurting someone else. the DA seems to think that we should not go ahead and prosecute without proof that he has moved back home but I say there is no way to prove it. I do not have the money for a private investigator. What should I do??
