What is the name of your state? sd

my wife and I recently separated after 8 years of marriage. we havent filed any papers yet. she left the home to live with her mom but she is unemployed. I know that i am still responsible for the support of my wife if she lives in my home but sd statute 25-2-12 says that i dont if we are in different domiciles. am i reading the law right or am i reading that wrong. She says that even tho we are separated i still need to pay her alimony tho we havent filed yet.

How long has she been unemployed? Does she have job skills, degrees? Simply being married eight years does NOT make you responsible to support her. You've been married eight years, as well, dude.

And you will only be OBLIGATED to pay her support if a court orders you to do so. Eight years is considered a fairly short term marriage.

nope no work skills really

she graduated from high school and worked a little when we first got married to help while i was in school but basically shes been a home maker. she got a summer job once but didnt stick with it. shes been unemployed for bout 4 years now

Are you "confused bout support ammount" or whether you have to pay it at this point.

It would be relatively easy for her to file for divorce and petition the court for alimony pendente lite. If you didn't have an attorney at that point, the judge would probably grant that motion without batting an eye with or without you in court.

Consult with a divorce attorney to make sure your intrepretation of the statutes are correct. From what you say that she says, you're going to need an attorney anyway.
