Confused-it's a long story

What is the name of your state? Texas

Questions:
*Is there any way for my sister to legally adopt both boys?
*Would there be many (if any) complications in doing so?
*If legal action were taken, wouldn't the judge see that that the biological "mom" is unfit to raise children?

I don't know what to make if this.
A friend of my sister's (since jr. high) has 3 kids.
1 girl, who's the oldest (lives with her relatives) and 2 boys.

The situation here, is that the friend is in and out of jail.
She gave my sister some kind of "document" (not sure what to call it) that she signed saying my sister could have temporary custody of the oldest boy while she was in jail, and when she got out, she would come and get him. We've (my family) had the oldest since he was 10 months old-hes now 4. She's been out of jail twice before, and hasn't come back to get him-not that we want him go in the first place. The friend was out on parole this last time and got pregnant. My family has this baby also. She's supposed to get another parole in April, and she said that when she gets out this time, she wants to take her kids back. She isn't a very stable person, and is no condtion to raise children. They be far better off with my sister. Far Better off.

I don't think it's at all fair to the kids-especially the oldest-we're the only family he knows. If he were to have to leave us, he'd remember it, and so would we.It would also be unfair to us, because we've been taking care of her children, and we've all become very attached to both boys. They're part of our family.

This whole situation is frustrating for rme!!! AAARGGHH!!!

Is there a father involved? You may want to talk to an attorney about filing for custody. There are too many scenarios that are not known to help at this point.
