In 2002 a husband and wife opted to live in seperate homes, but no one filed separation or divorce paperwork as they were still talking about the future.

In May of 2003, the husband passed away from a heart attack. The wife did not pursue his life insurance policy as he removed her as a beneficiary and she did not want to contest it so as not to anger the family. However, it has come to light that he lied to his company on his stock and 401K forms and informed them he was legally separated when that was certainly not the case as no paperwork was ever filed. He works for a well known company and in CT, you need to have a court issue documentation to have a legal separation correct? Yet this company issued funds to other family members without proof of the separation. Should these benefits have gone to the wife even if he changed his life insurance policy? I know some monies default to the surviving spouse, but was not sure if they all did.

Is there anything the wife can do in this case? Has the company done something wrong?
