today my husband was arrested on a bench warrant...a little backround...on oct 5 he got a DUI and was released that same day his bail was $2,000 but we didnt have to post bail or anything like that. His court date was set for Dec. 7th...the paperwork and court date have been sitting on my fridge since the DUI so when he was pulled over today for being on the cell phone they discovered the bench warrant and arrested him. He was released about 5 housr later and now we are confused since the officer at the jail stated that the warrant was for FTA for that DUI. My husband has not been in trouble other than for this occassion but it has caused much grief. Is there anything we can do about this?

About all you can do is find out if he can be bailed out and raise bail. You can also help him find an attorney. However, if he cannot afford an attorney one should be appointed for him at or about the time of the arraignment.

I read it to mean he was released 5 hours after he was locked up on the warrant.

What I don't understand is how she says that his bail (for the original arrest) was set at $2000 but that he didn't have to post the bail? Huh?

I believe that when a person is stopped for DUI and they blow over the legal limit, the arresting officer confiscates their drivers license on the spot.

So he may have been taken into custody because he continued to drive without a license?

Just a guess,,,
