What is the name of your state (only U.S. law)? VT. I had a pre trial conference set back in September of 2012. The defendant's attorney filed a motion to cancel due to the conflict of another conference on same day. Judge allowed. My attorney then put a motion in for a bench trial instead of a jury trial. The defendant's attorney told my attorney they would refuse, so my attorney put a motion in to waive the bench trial. Here it is mid January and no new pre trial conference date set yet? I called the courts and they are telling me my attorney put in for a waiver for a jury trial. What the heck? I called my attorney and he thinks it's nothing to worry about. Is there any way I can find out from the courts what is going on? Thanks. Faith

Ok, I could do that. But, I am wondering mainly if this time span from last September to the present is normal for pre trial conference being re set? Should I be concerned or is this normal?

The person to ask is the one with the proper training and local experience--your attorney. Write out your questions and ask him.

Hi, we again had a jury pick date for March. The courts again granted cancellation of this date due to the defendants attorney on vacation at that time. My attorney never received any motions, only a notice from the courts the date was cancelled, again. Can we argue for a bench trial instead of a jury trial, even though defendants attorney can say no they want a jury trial? Oh and the next jury pick isn't for 6 months. We have been ready for a year! This has caused problems with my husband's job due to constant rescheduling for my trial times and then it being cancelled. Ugh.
