I took a job in a plant this past october.I fill 50lb bags and stack them by hand onto pallets, this is non stop except for my scedualed breaks, i fill about 600 bags a night and handle each bag twice, so its repetive lifting. In mid november i pulled a muscle in my back , i filled out an accident report, but didnt loose any work time. My employer requested a meeting with me where i told them i was having a hard time keeping up with the lifting and it was causing me pain. They told me that was my job and i would get beter over time. They told me they would help me by having some others in the dept. aid me. For the next few weeks i muscled through the filling and lifting without help, i was popping pain pills to just get through my nights. I found out from other employees that they were aproached and directed by mangement not to help me in anyway with the filling or lifting , just to help move my pallets after i already stacked them, which was contradictory to what management had told me in my meeting.Other employees on the other shifts were recieving help from others in their filling and stacking . In late december i realy injured my back to a point where i had to leave work and go the hospital. I was diagnosed with a back strain, nothing to serious but it needed time to heal. The doctor wouldnt allow me to do either my duty or light duty but signed a form from my employer allowing me to what they called retraining. This retraining turned out to consist of watching videos for 4 hours a day with a supervisor, and for min wage, when i was making double that. Its now been over a week and ive watched the same videos over again about 3 times now and its starting to wear on me, i asked management what the reason for the videos was and they stated it was just company policy. worksers comp is taking care of my medial bills and theropy and supposily my lost time wages i havent heard anything about. The problem i have is that i really dont want this job i feel to a degree that they are to blame for my worsend injury, by taking away the help they promised me.i personally belive they were trying to get me to quit by making my job too hard for me to take. Plus i know once the doctor clears me to go back to full duty , i'll be back in the same boat and risk injury again. So what can i do ? and what are my options. Can i quit my job and still collect lost time wages until my my doctor gives the ok to go back to work. Does my employer have the right to force me watch the same videos over and over again at half wage. Whats are my odds that Ny state will not give me unemployment insurance for quiting, even though im not physicaly able to my job and i think my injury proves that. I just dont want to put myself in a bad place were i have no income comming in, i already live week to week and am alrerady falling behind on my bills especially with an unexpected injury just after christmas. Any information or advise on what i should do would be greatly apriciated. Chris.
