I received a letter from the DMV that I will lose my license for refusing a blood test. In the hospital they said that I accepted and they even have my BAC at 3 times the legal limit. In the police report it even says I requested a breathe test. My lawyer is pretty confident we can get it down to 120 days with this info. My question is... is there anyway to get my license not taken away?
The reason they said in the letter was not because of my BAC but because of the refusal. I didn't refuse but will they still take it away because of my BAC? Any help would really be appreciated thanks so much.
 


Talk to your attorney. I believe you can request a hearing before your license is suspended.
I would not state that the BAC test is considered accurate...just that it was taken. But they could be referring to the police road side test, and I assume that you did refuse this..am I correct?
