Ok to make a long story short I left my daughters father in early May of this year.Our daughter is 18months old now he and I were never married and were together for almost 2 years. In July we had decided on a agreement and both our attorneys typed up a consent judgment and we have followed it since july. Today I find out that it was never sent to the courts mix up by both attorneys but i feel so blessed it never got there. We had agreed on co-domiliacry status sharing 50/50 him paying me child support for 48 months then it reverting to the la child support guidlines (I never relized that having her the same amount of time neither one is obligated to pay support when are agreed upon 48 months was over. Alson had in the judgment me paying medical insurance and him getting her as a tax write off every year because he will be paying for private school when she starts ( I would have to drive 45 miles one way to that school)...The biggest thing is I do not agree now after 5 months of the visitation schedule we have which is me 3nights him 2nights me 4night then him 5nights then it starts over. My 18month is complelty confused she is throwing, biting, pinching, pulling, putting her fingers down her mouth till she throws up is yet saying any words Im very concerned this is not in her best intrest. Im going to court for full domicile with him liberal visitation. Just scared he is a small buss. owner makes really good money or might I say has alot of money. He works from home....I did not work the two years we were together becuase i did not need to. Since I left him in may he started paying me support which is enough for me not work and stay at home with my 18month old.Is that going to look bad in the courts eye that I do not work and his support is what supports me? Am I wrong for changing my mind to something we agreed upon? Do I have a chance at getting domicile?

You are not wrong for having a change of heart based on what has been going on. At a minimum that's a bad schedule for an 18 month old. An 18 month old shouldn't go more than two days without seeing each parent if they are used to each parent being a constant in their lives.

However, you are wrong that in a 50/50 situation that child support is not paid. In a 50/50 situation the parent with the higher income does still pay child support. You however would be imputed an income based on what you could actually earn.

since you are both at home, it's really a toss up at this time. the courts will have to use other factors to decide.

however, i have a 19 month old, she also sticks her fingers down her throat causing a gagging reflex. she does this for attention and thinks it's hilariaous. i pull her fingers out of her mouth, and put something in her hand, like a baby book, or a toy. don't react to the gag. sidetrack her. is seems to work, she hasn't done it in a week.


biting, she started doing that, we have been teaching her to kiss instead...and make a HUGE fuss when she does it. even when she kisses my knee out of the blue. she loves the reaction. which was why she was biting. to get a reaction.

and not saying any words? go speak to your doctor about it. she may be referred to a speech therapist.

Thanks yes I have had a speech therapist come to the house and evaulate her they are not concerned till she is 2 then then will re-evaulate. As far as the staying at home whenever he does not have her he is on the road to ms or mi or all around la. When she goes to his house on wen. and thur. during the week she goes to daycare at least one of those days so he can get phone calls and errands done for the bussiness.
