My spouse and I have been separated for over two years. We have a consent order stating that she is to make the auto payment. The auto is in my mothers and mine name. My spouse is not on the paperwork as being even a co-owner. My spouse has defaulted on the auto payment for the past 4 months. Can I take possession of the auto since payments have not been made? What would my options be?

What state? Is the "consent order" issued through the court?
