Does a filing in probate court for conservator for a minor require an advertsement?
No.
Does it always require a bond if the estate is large ($100 K+), or is it discretionary with the judge?
No and yes.
Explanation: Yes, it is a discretionary decision with the judge for a bond to be posted.
No, it does not always require a bond. The estate can be put into a "depository" account. Wachovia bank does this via their Guardian Angels office located in Pompano Beach, FL. The GA office can do this via phone with a local branch; however, the GA office will require the proper paperwork first. Would you like the phone and fax numbers?
If the will was probated in a county different from where the minors live, is the guarianship application still filed in the county in which the minors live?
Guardianships are jurisdictional. Due to the fact that this is a probate, it will be the judge's discretion of whether or not the guardianship of the estate will be in the county where probate is or the county where the minor lives. However, you can petition the court to have the guardianship of the estate moved to the jurisdiction where the minor lives. On the other hand, Wachovia is nationwide. Therefore, I do not see how this would matter too much except for the distance for the annual accounting.
