I am a 27 yo female, Registered Nurse, married for 5 years with 1 small child. After the birth of my daughter I joined a gym. During the summer the gym came under new ownership. Now the new owners want to charge for childcare when it was previously free. This has got me thinking......even though the back of my contract does say that childcare is subject to change without notice....we the members were never informed about the new ownership status before it was a "done deal". So, at the time of the switch over in ownership, shouldn't the existing members have been given the chance to nullify or modify thier contracts?? Do I have to continue to pay dues now that things are changing at the gym? My best friend called to talk with the new owner & he was really very hateful to her, he said that if she didn't pay her dues, he would send her to claims....come on...she I both only owe $120 for until January? So What do you think?

My response:

The change in ownership has nothing at all to do with your situation. The charge could have, theoretically, been made by the old owner. And, since your contract says "without notice", the new owner did not have to tell you, or to confide in you, or to take a vote with you, or anything else with you. And yes, he can, and most probably will, send your account to collections. That's his right. All because there's a new owner, doesn't give you any greater or lesser rights under the contract.

Bottom line: It's the terms of the written contract!! You want kids in this life? Pay for them!
