What is the name of your state? California

I have put my 4 year old in a new private (pre)school which supposed to open the doors
this fall ( July!).
Not that the opening is delayed until now (October!) it seems it is going to take another few month.
What they did is they arranged near by other classrooms for the kids and put two classes together.
My girl is not really happy there and I want her out.
I have a contract with them in which they are not exactly writing the opening date
but in their broschure and ads they say the school opens Fall.
I have paid a deposit which they say is non refundable.
She has also 6 week probe time at the school.
My question is can I get out and get my money back?????

well I have a 6 week provisinal acceptance and as they write during this time they
refund the tuition, but on the other hand they say the tuition deposit is not refundable
or transferable what does that mean ???
and I also paid for an insurance plan in case of withdrawl, dissmissal etc.

of course there is the fact that the facility I am paying for is not finished and if they say
they are opening July Fall 2006 doesn't this mean anything.

Nope. October is still fall as is November and technically part of December. They are providing a service to you since they have alternative classrooms set. For what reasons are you allowed to break the contract?
