Contempt for no-showing at Drug Court??

What is the name of your state (only U.S. law)? LA

I am seeking advice on how to handle this.

1. 2007 - dad and his wife tested shadowy on drug test (slapped on wrist by judge)
2. 2008 - Judge noticed that dad had narcotics on several drug screens and dad provided prescription after the screens. Judge was given empty pill bottle for 50 pills prescribed 7 days before court. (slap on wrist, and ordered him drug court until she says when to stop)
Dad's attorney pulled up online records on what he made out to be crimes my dad was convicted for, however my brother who is a JR was guilty of those misdimeanors. Judge found in favor for dad and ordered grandfather (my dad) who lives with me and my daughter not to drive or be alone, due to "consuming alcohol" however grandfather was not there to defend himself. I did not know that it was my brother who did these things, because when it all happened I was out of state in college 16 years ago. Negotiations were in the works and dad stopped taking drug screens. I was going to drop his wife from testing in exchange for grandfather being able to pick my daughter up from school or bring her to extra curricular activities, such as art classes, karate, and gymnastics.
3. Dad did not accept negotiation and stopped testing anyway. Dad has taken a total of 1 drug screens since January 2008, which was last court date, and his attorney will not forward over to my attorney those results. Dad and I are scheduled for random bi/weekly testing. I had to consent to testing in order to have him test, however I am in process of getting dropped after next court date.

Here is my question. Why is it that a judge would allow dad who obviously had too many narcotics in his system to drive my daughter around all high, however grandfather who was accused of drinking alcohol (it was brother who got the DWI) is not allowed to drive my daughter anywhere. How do I overturn the judge's decision and show her the proper documents that shows both my brother and grandfather's socials and clearly explains that dad's attorney made a huge error? Here is the kicker, dad admitted recently to me that he was trying to hang something over me. He stated that he was aware that it was my brother the entire time, and so was his attorney. He told me there is nothing I can do, because it was not presented as evidence, but when his attorney was dangling the document in the air, that was all that the judge needed to see without him presenting it as evidence. If I do go back for an appeal, and the decision is overturned would I still be able to seek legal fees from last court date in January, or is there even a chance of the judge overturning her decision?

This is my last question. How many times do I have to take dad back to court before he is found in contempt and what are usually the consequences if he has narcotics and marijuana in his system? Thanks.

you know, i remember reading this yesterday. heres the thing. it's a bit confusing. on this site, MOM and DAD are usually in regards to the child in question's parents. I think, and i could be wrong but it's looks like DAD might be YOUR dad. maybe if you changed YOUR dad to grandpa, it might be more helpful to read.

and THANK YOU for changing the bio-dad. and if there is a stepdad in the picture, refer to him as such.

A: You appeal the decision.

A: You can ask for anything. There is no guarantee you will get anything.

Your post is confusing. Who is dad? Who is father? What does the brother have to do with anything? Who are you?
 
Thank you so much for your responses. I have updated my thread to help you more. My parents live with me and my daughter. My dad has a son with the same name as his. My dad was mistaken for my brother in court, since the charges did not have Jr or Sr after them. Because of these false allegations, my father is not allowed to be alone with my daughter, however it was my brother who was convicted of the crimes. HOpe this helps better. Now to answer your questions:

The judge was in possession of a prescription for narcotics after dad failed drug screen. He obtained a prescription 3 weeks later. The bottle was empty and prescribed 7 days prior to our court date. The judge slapped him on the wrist and ordered him to my district to be tested so she can monitor him. As for grandpa being accused of being an alcoholic, grandpa was not convicted of DWI, and judge assumed that grandpa is a raging alcoholic that should not be alone with my daughter, but has no knowledge that dad pulled online court records reflecting charges for my brother.

IsabellaSoriano I hope I helped by changing my thread. That was one of the reasons I originally inserted biodad in there. Dad hates grandpa, and is out for vengence. I guess because our girl worships grandpa, but there is nothing I can do about it. He is not an involved parent, and can be, but he chooses his own path when it comes to being a parent.

Okay, I completely agree to that. Both Grandpa and Brother already went to the Sheriff's office the day after court and showed proof of identification to include socials. Grandpa has a letter from the Sheriff's office stating that he had not convicted any crimes, nor was he guilty of any misdemeanors. The only crime he convicted was buying a house with my materialistic mom! hahaha

Can Grandpa go to the judge and show her this, or do I have to pay another $5,000 to my attorney? I just feel like my money is going down hill, and I am getting no justice. In the meantime dad is living it up, and continues to defame Grandpa to family members. Grandpa really is itching to make an appointment with the judge, but I don't want him to do this behind my attorney's back.

Make a copy of the letter for your attorney, and get his/her opinion on how to proceed. However, if your attorney would charge 5k to handle that, you may need to consider changing attorneys.

It might. but here is the thing -- the child's father has a constitutional right to parent. Grandpa has NO RIGHTS to the child.
 
You are correct Ohiogal. Grandpa and Grandma live with me and my daughter due to damage from Hurricane Katrina. My hours sometimes at work require me to stay past 7pm at night. Grandpa would pick my daughter up from school and bring her home on those occassions and is a huge help to me and to my daughter. Dad leaves our daughter with stepmom to go smoke pot and run errands and was ordered to not leave our daughter with stepmom unless he was working and that was much emphasized by her in court. Stepmom should not have a consitutional right either, correct? I mean what's good for this goose is good for the gander?
