Contempt of Court/Perjury

I went to court for a DCSE hearing today on a show cause for failure to pay support. Ex was found in contempt and given 30 days to pay up. What is the next step if he does not?

After the hearing, when DCSE was calculating the amount that he had to pay within the 30 days I overheard the caseworker speaking with the ex's attorney about purging the contempt of court if it is paid within the 30 days. Does that mean it will never show in his support order file as ever being in contempt? Pretty much like it never happened?

Also, the judge said the DCSE hearing was a court of record. I heard the ex;s attorney talking afterwards about me and perjury. I have no clue what they are talking about and can only anticipate that they are trying to find something new to take me to court about. Wouldn't the court get tired of seeing us there??? It's like they are on a blood hunt for me.

if he does not pay he would be in contempt again, possibly even have a warrant issued for his arrest

I wouldn't worry to much about the perjury thing (unless you aren't being honest here) it's his lawyer's job to look for angles that may help his client

As far as the perjury is concerned, the only thing I can think of is the ex's attorney asking me whether or not I had requested money from him and if the amount was for child support since it was paid directly to me. I said no it was not for child support but instead for a bill since I'm a single mom and was struggling. I honestly have no idea what it was used for. That's the only thing I can think of.

I know that the attorney kept asking for discovery but the judge said no. The judge said the parties are under oath, their testimony seems credible and I'm taking their word for what they are testifying to.

you asked him for money, he gave you money, but you have no idea what it was used for? what am I missing?

:rolleyes: you ask to many questions...we were still having a side fling but not living together - therefore, sometimes money was not at all for child support (such as bills)

ah, well he certainly had the option of writing you a check and putting child support in the memo line, he didn't, he can change what it was for now

If he doesn't pay within the 30 days the court will most likely issue an arrest warrant.

If he pays within the 30 days this particular contempt charge will be "purged". However, the contempt record will stay in the file.
