What is the name of your state?Indiana :confused: If I want to file contempt do I have to pay court costs? I wouldn't have to go to court if CP would follow order by judge and let me see son on regular visits instead of keeping him from me.

Of course you do. You can ask the judge to order the ex to repay them (and s/he may or may not do so), but you'd have to pay up front.

Im in Illinois and we did not have to pay court costs to file. There was no fee.

I was wondering that exact thing. If states were different because my fiance' did not have to pay to file comtempt either. Which I found surprising!
 
I wonder if you can defer the fees pending judgement againt the other party or a complete waiver for financial reasons or the deferral would allow for payments. In AZ this can be done, but has to be requested and then granted but I would look to see if the same is an option in Indiana.

Call your local courthouse and ask. My husband filed for a modification last year and we had waited because we wanted to have the filing fees and there were none. We were told all the fees were paid at the time of the divorce. I realize the modification and the contempt is different but it doesn't hurt to ask.
