What is the name of your state? WI

My son's mother was found in contempt of the court order in early February. She was given until Tuesday of this week to complete the provisions of the contempt order. She only fulfilled one of three. My lawyer said he would get a bench warrant for her arrest.

I'm wondering what exactly that means.

I know that she can't be "picked up" if she gets pulled over for anything, but aside from that, what are the actual chances that she will be arrested?

My concern is that she may get pulled over and arrested some time when my son is in the car with her. He would be terrified, and I don't want this to happen. Ideally she would get picked up before the next time my son sees her, because I'm sure her family will pay the fees she owes and she will be released. My son never has to know about it. I have considered calling the police in her town and asking them what they can do about it, but realistically, is there anything they can/would do? Or do we really just wait around until the time comes that she gets pulled over for something else and they see there is a warrant out for her arrest?

And if she does get arrested while my son is with her, what happens to him?

You can always call and tell the police she has a warrant and she is located whereever she is and ask them to pick her up or tell them when she will be arriving to pick up her son BEFORE she picks him up.

I was thinking that if I did alert the police to where she was going to be I would certainly do it before she picks him up. There's no way I want him to see it if she gets arrested.

The only problem is that she hasn't been driving her own car for a couple of months, and every time she comes to get our son she's in a different car. There's no way I could alert the police to what kind of car she'd be driving until after I see it. Unless I were to try to find out ahead of time, but that might be rather conspicuous. I don't want her to see it as a set up - things are bad enough between us as it is.

I just want it to happen in such a way and at such a time that my son doesn't even have to know about it. He's only 5; it would be traumatizing.

What you do is tell them when she is coming to pick up your son and have them there at the location.
