Decedent purchased life insurance policy in Jan, 2000, which included a two year incontestable rider and provision for refund of premiums if death caused by suicide within two years. The policy was reinstated in Jan, 2004. Disclosures on the reinstatement app regarding health care may have been misrepresented or omitted. Insured committed suicide in Nov, 2004. If misrepresentation regarding medical condition was made in Jan, 2004, but the cause of death was suicide, can the insurer successfully deny the claim?
