Contested Divorce with children

I am a resident of GA and my "wife" is a resident of VA and my children live with her.

I have tried everything under the sun to get my "wife" to sign divorce papers. I even hired a lawyer to do a mediation so he could explain everything to her. She is still refusing to even send back the financial information to determine child support. She wants more than the courts would require me to pay because I use to own a successful business prior to the economy busting.

Can I file the contested divorce in GA? I'm getting two different answers, one lawyer says yes, one says no.

I'm sick of waiting to re-marry as we have been seperated for 10 YEARS and have been trying the whole time to get her to do an uncontested divorce because I haven't been able to afford an attorney.

So that's my question. Can I file contested in GA? If you need more info please just let me know.

ETA: We have no assets, no debts, no joint property, nothing other then two children (13 and 14). I am not asking for custody, nothing. Just want a divorce. Quite honestly I think she is just being spiteful. It ridiculous.

You could get a divorce in GA, but the GA courts could not making any rulings regarding the children. GA does not have jurisdiction over the children.

Because my fiance posted the previous one for me and I couldn't find it.

Also I didn't know I asked about a contested divorce being filed in GA because a lawyer just told us I would have to file in VA. So that's why...sorry. Forget it. I will call around to lawyers tomorrow when they are open. Some of ya'll on this board are so damn rude.

No one was rude to you. The rule on this forum is one situation, one thread. It makes life harder for anyone responding to you to have to go hunt down your post history to get the whole story about your situation. We also discourage multiple people (like you and your fiance) posting under one user name.
