Our home needed homeimprovements due to storm damage. We met with a contractor who had typed up a contract with what needed to be done and the cost involved. Some items needed to be changed so they were crossed through and then hand written in including "Contract contingent upon insurance approval". each was intialed by us and the contractor. We signed the contract as did he and gave him a check for 1/3 of the total, which they have cashed.
We and the contractor called the insurance company to expedite things. However, the insurance compnay did not come up with enough money so the contractor asked if we wanted to set up financing as waiting would delay when the job could be done and materials had increased 15% since we had signed the contract and we would want to be sure not to have to face paying the increase. We said we were not interested in that and that I had found some discrepencies so I was going to call the insurance to see if we would be getting more money. The contractor offered to call also, I said I could handle it. He then told me we only had 10 days to finalize things as the contract expired 30 days form the original date. I told him I did not see that in the contract(which it is not) or remember it being mentioned before.
The insurance company did come up with another small amount - still not enough to cover the entire contract. The insurance company said that we could use a different contractor if we chose to, but to make sure we were released totally from this one first.
We have found a contractor that is reputable and will do the work for the amount we have. I plan to ask for my money back and would like to get something in writting from them that states I am under no obligation or contract with them. In other words I want to make sure all my bases are covered before signing anything with another company. Can you help? We live in MN. if that matters.
Thanks.
