What is the name of your state? Nebraska

I am set to move into a townhouse with two roommates. However, one of the roommate's rental application was denied. We are considering moving in anyway with only two of us on the lease. In this case the landlord would have no knowledge of the third roommate. In this situation, would a contract between the third roommate and us (one stating she will pay her share of rent and bills) be legal and binding?

To do so would essentially be the same as knowingly, and willingly, destroying your credit!!! You would be entering into the contract, in violation of the terms.

Roommate situations RARELY work out, and in this instance, you should ask yourself why you would even consider jeapordizing your credit for someone who has already screwed theirs up??? You would be in the same boat--unable to rent, purchase a car, obtain and keep open lines of credit...and the list goes on, for a lifetime!

DO NOT DO IT!!! Period!

Oh and by the way, the Landlord may not have knowledge of the 3rd roommate yet...But I PROMISE you, s/he WILL soon know; and the results for you and roommate #2 will be no better than that which roommate #3 is currently facing!

I tell you this for YOUR own good, and I REALLY HOPE that YOU WILL HEED MY ADVICE!!!

The contact between the tenants would be enforceable but the lease with the L will be subject to termination due to default since L did not approve the T.

The local newspaper here in my parents' town (Yesterday's edition) includes an ad for "an experienced blackhoe"...would that be found in the same district???:D
