I put a piece of land on the market to sell on my own in May 2019. I was contacted by a agent who had listings on the same street. We will call her AGENT. She convinced me to sign a 6 month contract with the broker she worked for. I signed the contract in June with the BROKER, the AGENT is not listed on the contract anywhere. AGENT removed my signs and did not replace with AGENTS sign as agreed but did list through a MLS#. We agreed to list the property high so we have room to come down at AGENTS advice. I have proof of this along with contract with BROKER. I trusted AGENT to advise me when to lower price, etc. Do to life I didn't worry about it and trusted AGENT/BROKER to hold up there end. I don't feel this was done. In October, I had not heard from her so I contacted AGENT to ask if we can finally lower the price in Hope's of selling. At this time AGENT informs me that AGENT no longer works with the BROKER I sign the contract with and that my contract transferred with AGENT. I did not understand how this was done legally without my knowledge. AGENT agreed to provide me with proof that AGENT now holds my contract. BROKER said I requested to have my contract transferred to AGENT through calls and emails. This is false, and was the first and only time talking to BROKER. I did call on Friday and was told BROKER would call back. I called back and spoke to her on Monday afternoon when BROKER had not returned my call. BROKER is gathering proof that she has of the contract transfer request, and said it will be ready in a few days. AGENT wants me to sign a release, releasing her of responsibility. Can someone please advise me on where I stand legally and what are my options going forward? Would this be considered Breach of Contract? I was getting atleast 10 calls a day and had people very interested but the AGENT said she could get me more money and now said I listed it to high. The listing price was below what AGENT wanted me to list it for. I have proof of this in a email. Any guidance would be appreciated on if I should take this to court or cut my losses, and wait 60 days (per contract) after the contract I signed is up. Thanks in advance.
