I sold an easement to a Florida utillity. Our contract states that my land will be returned to a "natural state". When asked what that meant, their representative explained that sod and pine trees would be replacing the removed oak trees. We were also promised to be notified, so that we could be on property to try to "save as many" of our trees as possible. Our first notification (recorded phone message by their representative) was that all the trees were gone, he was sorry and maybe they could write us a check to "remove the sting". They proceeded to throw some grass seeds down and ask us to sign off as satisfied on the contract. We have estimates of around 5000 dollars, to add the sod and trees, and were considering small claims court. To me, an offering of a check seems like an admission our agreement was unsatisfied. Do we have a case?
