I have a combined question. I am a graphic designer and have had a relationship with a company as a subcontractor for many years, on and off. We have never had any kind of written contract. Even individual projects have not always had anything in writing, sometimes a P.O. I have always had the right to also independently develop my own clientele in addition to the work done for this client. I have done no work for this client since February. A client of this client APPROACHED ME several months ago to do a project. He told me he was not going to use this other company, whether I did the work, or another designer did. I did work with them. My client has just discovered this and is threatening legal action. Does he have any recourse? 2nd question is related. He is now demanding me to turn over any and all materials related to any and all work I have ever done for him. Does he have the right? Does he own this material? Or do I as the creator? Or do his clients, as the actual recipients of what I created? Even if he should have the ability to ask for the files, wouldn't the actual media (disks) belong to me? Thanks for your help.
