What is the name of your state? WI
We put down earnest money on a home from private owner
They gave us a receipt thats says the purchase price and the
earnest money put down. We signed no binding contract.
We changed our minds and ask for our earnest money back
They refused stating we gave no good reason and the earnest money
would be used to lower there asking price. We then sent them a certified
letter requesting our money back at such a date which they havent replied
it has been 3 days past. Can they keep the earnest money without a
binding contract, or is the receipt consirdered binding?

**A: state exactly what the receipt states. Also, why did you change your minds?

The receipt stated this I (owner's name) received (amount of earnest money)
on 4/24/05 for the purchase of (address, city, state) purchased price is (then price)
Signed by the owner and then my husband signed with date of 4/24/05
We changed our minds when we read the contract stating our closing
date was on or before June 30th ... (also second thoughts on location etc.etc wasnt right for us) Our present home is on the market
and not sold. We discussed this with the seller ( verbally) only!
Also it says in the contract we were to sign but didnt this:
{BINDING ACCEPTANCE} this offer is binding upon both parties only if a copy
of the accepted offer is delivered to the Buyer on or before May 6, 2005
CAUTION ..... This offer may be withdrawn prior to delivery of the accepted offer...... The contract is called WB-11 RESIDENTIAL OFFER TO PURCHASE
