My potential clients entered into an Exclusive Recording Agreement with an entertainment company. The owner of the company has not lived up to his end of the agreement, and is presently incarcerated for fraud and writing bad checks. How difficult would it be to have the contract declared breached and voided legally so that they may continue to pursue their careers?

Entertainment contract

This one takes some judgment. If you are sure that the entertainment company breached their contract, and if you are sure that you can prove that, then you don’t have to do anything about the contract. Your clients can simply ignore it, and if the company sues them, they can defend on the basis of the breach. But if you chose to go this way, be sure you have a good case.

Otherwise, you can bring an action for breach of contract. It sounds like the person has no money to pay damages, so you can bring it in small claims court. Your clients would probably win. Even if they could not collect damages, that would be a court declaration that the other party breached.
