1. my father entered in to a agreement with an attorney whom ended up in the hospital with bypass surgery, whereby the legal work was turned over to an associate.

2. my father paid an initial retainer of $ 5000.00 for legal work required in purchasing a parcel of land in NM. (aware you are CA. attorney).

3. the initial legal work to be performed was to make absolutely sure that there is access to the land and there are water rights.

4. my father requested that was not to be any other legal work done until these two points were validated with a positive outcome.

5. the county court house was under construction and the records could not be accessed. The attorney that the account was turned over to went off in another direction and worked on the family and their requirements to sell the property. This land parcel has been my father’s fiancé’ family for many generations. All the current legal work that was performed has to do with legal mental competency of a relative of his fiancé’s.
This work accrued another $5,000.00 in legal fees without the question of water rights
And access being answered.

6. the requested legal work was not addressed. He feels he has received no value for legal services regarding water rights and access to date.

7. the attorney wants now an additional $ 5000.00.

8. he feels he should get a substantial portion of the monies already paid returned, plus be totally from paying the additional fees required by counsel.

what should he do?
