We live in Arkansas and built a home 3 years ago, moved in and had several problems with the house including water problems in the basement. We had a year warrenty on the house and would call the builder almost on a daily bases to complete the needed repairs. Needless to say they were never completed and I went to an attorney. This attorney wrote the contractor several letters and we with the attorney even met with the builder who agreed that he still needed to fix the problems. After six month with no word from the contractor ,we called the attorney to start legal proceedings. Its been almost two years and the attorney still has not filed suit. I don't know what to do anymore. Should I hire another attorney or stay with the one we have since he has all the paper work? What are my legal rights at this point with the contractor? Thank you.

The attorney works for you not the other way around. Fire his/her but and get a proactive one. The entire file that the attorney has is yours and can be transferred to the new attorney. I give builders 30-60 days to complete a pnchlist and if not, boom, they get a visit from the sheriff with complaint in hand.
