Contracy Between Roommates

I am set to move into a townhouse with two roommates. However, one of the roommate's rental application was denied. We are considering moving in anyway with only two of us on the lease. In this case the landlord would have no knowledge of the third roommate. In this situation, would a contract between the third roommate and us (one stating she will pay her share of rent and bills) be legal and binding?

What are your plans when the landlord evicts you for housing this person who did NOT qualify....

Well, yeah. But so was her boyfriend cheating on her with a 16 year old after she subletted her apartment to live with him. I feel really sorry for her and want her to have a place to live, but while making sure I don't get screwed over.

*** Of course we can't tell you if a document will create a binding contract without reviewing the actual document. However, I can say that though it MAY be binding between you (making the 3rd person a SUB-tenant of the two of you... and you his/her landlord), it could also create a situation where you are in breach of your lease with YOUR landlord.

Enough to offset any rent charges they would have otherwise been liable for, with no regard to the landlords occupancy standards?
