What is the name of your state? Nebraska

* (in reference to the title) - I wasn't "convicted" - I was picked up for the dui this weekend.

Here's the short version of my situation. I attended a wedding Saturday afternoon/evening and was enjoying the celebration with alcohol/beer. I went out to eat at the end of the night and ended up sleeping in my car for about 3 hours and couldn't get back to sleep. I decided to make the 2 hour drive home and was stopped at 4:30am for crossing left of center at which point the cop asked if I had been drinking. I admitted to it and was given a BAC test (.114). I was jailed and car was impounded. This is a first offense for me, I have no tickets, etc. . . My court date is June 13 and my wedding is June 17 (this was a very dumb thing to do before one's wedding). I fully intend on hiring an attourney at this point

My question(s) to whomever would be kind enough to respond:
1) I have fully accepted my idiocy and am sticky kicking myself for everything. I mentioned my wedding is coming up really soon. Does anyone know of a way to get the trial moved until after my wedding date and honeymoon or if it is at all possible?

My response:

Oh, yeah . . . you're definitely a hilarious guy! Yes, we'll put the Justice System on hold just for you!

Unless you and the new wife are going to the local water park for your honeymoon, you're not going anywhere. As a matter of fact, I doubt you'll even get that far!

Yes, you're a funny fellow.

thank you

Wow IAAL,. . . wouldn't have expected a lesser response from you and so quick to pass your personal judgement too! No, not hilarious ever. After having read other posts on this site for the last 2 hours I seriously wonder about your credibility. Most of them sound like you are trying to rile someone up so they end up swearing and oweing the administrator $250 for the use of foul language. Does the "Pro" in "CALIF-PRO36" mean provoker rather than professional?

I appreciate the good post though funny guy. I'll take that as a "No, this is not possible."

MY RESPONSE: Yes, I'm prone to pass my personal judgment on drunks that drive, placing others in danger - - especially with a BAC of 11.4. That's it, take your anger out on me! Be pissy! That's all you have left. You have only yourself to blame, and you've absolutely ruined your future bride's day and all that planning and the expenses that are now down the tubes. Way to go, Clowny! What I'd like to know is what are you going to tell all your guests when you're a no-show at your own wedding? You remind me of that picture of the Bald Eagle, talons fully extended, about to pounce on a mouse - - and all the mouse can do is flip off the eagle!

MY RESPONSE: Nothing is impossible in this situation. It's just not likely. Does your fiance know how to use a water slide?

What a dufus!

my advice

talk to a lawyer.

first court date is usually pre-trial, not trial.

You will have to show up.

You can say you have decided to hire an attorney before you enter a plea, or you can have a attorney and enter a "not guilty" plea in which then a trial date will be set.

Not sure how it goes in Nebraska, but that is how it is in most states.

Most likely you'll be found guilty anyway, but you may be able to buy some time before you enter a plea or are found guilty.

You didn't kill anyone, remember this FOREVER though, and if you drink when you go out, have a sober driver or take a cab. ALWAYS!!

People make mistakes, that's why there are lawyers and judges and treatment/education programs.

Hopefully you can get a trial date set for later, and even though a court date will be a drag the week before the wedding, you should be able to enjoy your wedding and your bride and your honeymoon.

I got two dui's in the past three years after having a brain hemorage and losing my father in the same year four years ago.

I, uh, have been suffering from a huge bout of depression and head trauma which lead to alcohol abuse/addiction. Be upset at yourself, but also be understanding and don't let this ruin you. Pay the price and move on. Hopefully your girl really loves you and will stand by you through this.

People yelling at me that I was a stupid drunk or idiot or making fun of me sure didn't help and only added to the depression. Saying I could have killed someone which is true. Both my dui's I got going 5 mph and I was crying.

Took cat scans and mri's to have it explained to me what was wrong with me.

Get to some A.A. meetings(they are not that bad, and you learn alot) and bring a sheet to have signed saying you were there and bring it to court, sign up for a treatment center before the trial if you do tend to enter a guilty plea.

You can hopefully get the time to enjoy the wedding.

Talk to a lawyer before you hire one and get a consulation, get two. They may see things to get you off or tell you what I just did.

You were "convicted" of DUI? Over a holiday weekend? Wow! Your courts are tough!

Hire an attorney and see if he can get the date postponed. Don't count on it, though.

You can always ASK ... but they do not have to permit it.

Thank you Bumming123 and CdwJava for your recommendations. It gives me a better understanding of what to do and what to expect. I certainly realize that I have to accept the repurcusions to my actions and realize what I had done could have ended up worse. For this I am very lucky and will not make this same decision again in my life. I am submitting myself to AA this week because it turns out (from a conversation with Dad today) that there is a problem with alcohol in our family. Now knowing this I intend on removing the substance from my life, but will need the support from a group as I have low self-esteem and alcohol always seemed to help.

Thanks again I appreciate it
