I have a small claims suit against my ex wife for a breach of contract. In a nutshell, she agreed via email and verbally to allow my son to attend my wedding with me in Canada and then at the last minute she told me I couldn't take him. I had purchased a plane ticket and tux for him. When I went to the first trial, my ex was not served, so a continuance was ordered. But the judge told me that this was a family court matter and he didn't seem too interested in ruling about it even if she had been served. Now I have another court date scheduled in March, but fear that he will throw the case out and tell me to go to family court with it. I was told that family court doesn't award monitary damages, hence why I took it to small claims. I feel she breached our contract and caused me punitive and actual damages. How can I convince a judge that he needs to hear the case?
