1) Is the Terms of USE contract found on most websites legally binding even though if a user is never required to consent by Clicking “I agree”?

2)Is it illegal to copy factual information from a Website, for example if I copied the telephone number listed on a web page, and then posted it somewhere else or used it to create a yellow page directory without getting the permission of the owner first?

Both of my quesations are in respect to U.S. law in the state of california.

1. There are a lot of variables. We would need more info, better yet, a link to the site.

2. You are talking about 2 different things. You can pass along factual information and phone numbers, you cannot publish the the factual information or phone numbers without permission of the owners.

For example apple.com terms of use doc, Is that document legally binding even though a user never has to click I agree upon it? A user can surf the site without ever even seeing the terms of use doc.

I want to create a yellow page style directory of websites with contact information. Will I have to get permission first? I will be taking information directly from websites.
