My response:

Song titles, book titles, movie titles, and any other type of title, are NOT "copyrightable" - to coin a word. You can use "Love Me Tender" for anything, including a new song - - just as long as you don't use Elvis' words or music, you can write a new song with your own lyrics and music.

You can use "Love Me Tender" for anything you want. As a matter of fact, there is a toy doll on the market that's named "Love Me Tender".

And, how do I know that? That's my secret!
