What is the name of your state? Washington
If I use somebody’s image for a background for a business cards and the website it is on (forum...www.deviantart.com) says all images are copyright but user doesn’t will I still get in trouble? And what if I asked him on e-mail if it was ok and he said yes...is that enough? I don't have to have some type of special contract or anything?

If you have permission to use the image from the person authorized to give permission, then you shouldn't have any problems. Of course, the difficulty with a verbal commitment comes when the other person changes their mind -- then how do you prove that the license to use the work actually exists?
