I was wondering if a friend on mine bought Windows 98, and then his cd got broke, and i also have Windows 98; Is it legal for me to burn a copy of it and give it to him? He would still be using HIS cd code that he did pay for.

What you want to do is not legal. The contractual expected use of Windows 98 is that the purchaser will install and use it on one machine. Your friend's CD rom drive broke so all he has to do is get another one. Your copying of your authorized version of Windows 98 for use on a second machine (his) is not legal.
