This is a fuzzy situation and I am hoping somebody could finally give me the right answer: how is it possible to copyright a movie or music of foreign national from a country which doesn't have any copyright treaty with the US?

My guess is that the work has to be published first in a "treaty party" instead of the original country. But then what does "Publication" mean exactly? For a movie for instance, is the work published when the producer gives the distribution right to the distributor, or is it only when the distributor releases the movie to the public? Or is it considered "published" from the very first projection in a theater? Tx.
