What is the name of your state (only U.S. law)?
I own a small retail nursery in Victoria, Australia that I have been running for nearly a year now, a lady comes in and hands me a letter that she wrote up herself and explains to me that I have copied her logo and that I should take all my signs that have the logo on it down within 14 days or she will take the matter further.
She then hands me a print out of her logo next to mine, there is one similarity, they are both a circle shape and both have a branch in the logo which are completely different. (not sure if I can insert a photo of the two logos together onto the post?)
I have since spoken to my logo designer who I paid good money for from a website called 99designs, I showed her the other logo and she was also quite shocked, she said she has all her work there showing her design process and that I can have access to that if I need it. I try to explain to the lady that my logo was designed by someone from overseas, how would they find your logo that you created in a small town in Australia?? But never the less she insisted that it is her logo that was copied and if she takes the matter further that I will incur all her legal fees as well.
I have had both logos looked at by a graphic designer and he also agrees that while they have some similarities, they are quite different.
So should I seek further legal advice about this or just contact the lady? Im not sure what to do from here, I have a very strong belief that if she did take me to court over this that she wouldnt have a leg to stand on, but then will that end up costing me a lot of money to do so?
Any advice would be greatly appreciated, I am happy to send anyone a photo of the two logos together as I cant seem to post it on here.
