About 15 years ago I was sent a picture from a boat captain in Australia. We requested permission from him to use the photo. He said it would be fine. We have used the photo in some advertising and recently on our web page (about 4 years on web page). However yesterday I was contacted by a guy in Australia who says the photo is his and is demanding payment of $500.00 for it's use. He still insists on payment even though I said I would remove the photo. (Apparently boat captain did not take the picture). I certainly did not intend any infringement. What are my rights? Thanks

If his copyright is not filed with the US Copyright Office, he cannot sue for damages.
