Costco&prescriptions-won't sell contacts...

Im in California, I get my eye contacts at Costco, my prescription runs out in a week so I went to load up on contacts and they won't sell me any!

I know this is so they can charge me $75 dollars for a new prescription, regardless, legally can they stop me from buying as many contacts as I want while my prescription is still good? Do eye doctors have a legal right to prevent someone from this? I want to take them on today so I need to know my rights and the law concerning this, any advice is very appreciated.

Any filler of prescriptions, whether drugs or eyewear to glasses, is only obligated to fill the prescription up to the expiration date. Costco was legally and lawfully correct to not fill the prescription.

the eye doctor at costco is an idependent contractor....they're only practicing good medicine by requiring a yearly or bi-yearly eye exam before allowing you to refill a prescription.....your prescription can, and often does, change between exams.

what happens if you've been wearing the contacts you "loaded up" on for so long that your eyes/vision is damaged? sue costco and the eye doctor? oy :rolleyes:

Doesn't matter. Costco would have only been obligated to supply 7 days worth of contact lens'. Even if one set could be used beyond the 7 days, they do not have to sell them. From a legal standpoint, no one that dispenses anything by prescription is required to fill it. Many pharmacy's are refusing to fill the so called "morning after" abortion pills. It is perfectly legal, the only option is to try somewhere else.

Since no one else asked, I will. What reason were you given by Costco in turning you down for the contacts?

Get a copy of your prescription (as they are legally required to provide) and go directly to another supplier and buy a bunch of contacts.

ok, so here's the way prescriptions work....

if you have a prescription for contacts that expires 2 years from the date it was written and you wear contacts that need to be changed every 2 weeks, you will be permitted to fill the prescription 48 times......doesn't matter if you pay for all 48 at once or order them as you need them. if the prescription is about to run out and the OP has already filled the prescription 46 times, they will only be able to fill it 2 more times......there's no "loading up" to avoid paying for another eye exam.

and, although they may be able to get a copy of the original prescription, NO ONE will fill it for more than what would be appropriate for the expiration date. if the OP is running it through their insurance company, the amount of times it has been filled will be noted in their computer file....
