A lady backed into my car that was parked on the street and did $900 in damage. I did not find out until 3 hours later that this happened because I was sleeping, so gave a neighbor her phone number to give me. I called her and said she would pay for all damages, just no cops cause she had no insurance, plus she didn't call the cops at the time of the accident. So I made up a contract and we both signed it. Long story short, 5 months later I'm taking her to small claims because she won't pay. Can I be fined or anything for not calling the cops myself? Also, will she be in trouble for not notifying the police, eventhough she was unable to get ahold of me?
