I am being sued in Small Claims Court in California. I own a small business owner and am being sued over a business transaction. I believe that this is a frivolous lawsuit and there is a good chance that the judge will see what a nut case this person is. Can I counter sue this person for my time, at my standard hourly rate, if they lose or is this another cost of doing business.

I am not sure about CA, but in CO you can counter sue the plaintiff for any costs you feel that they owe you (i.e. time lost to defend a suit, court fees, etc...). You may want to log onto your AGs website and check the rules for SCC or see your county court clerk.
