What is the name of your state?Idaho
Our local county commissioners have let my next door neighbor develop a County Avenue that borders my land by 300ft. I never received any notifactions from the commissoners, although I have voiced my oppionion that I did not want the road developed. The commissioners told me It was not a county issue, although they have let this neighbor who already had a road to his property build it anyway. Well I thought at least they would make him build it to code. Boy was I wrong!! It is the worst looking road I have ever seen, and does not even come close to being county code. The burden of that road lies with in my property, the neighbor who build the road only boarders it by 60 feet at the enterance of his home. At the lower part of the road he came right up against my property with the road leaving the runoff and ditch on my property that will eventually flood my barn. My question is how can the county do this to me? Where is my propery rights? Not having the road put to a code devaluates my property! I really feel that after talking with the commissioners they don't even care. They let him build it, yet they tell me this is not a county issue. It's a County Avenue!!! how can it be not a county issue. If I had to fight the county on this would I have a leg to stand on? any help would be greatly appreciated. thanks

Tonjuark,

As you can depict from my signature, I have no idea
on the proper handlement of such complex issues.
It is his property and the road doesn't intrude upon your own.
Take photographs of the runoff and ditch and send
it to the City or something and inquire if anything can be
done.

Point being, you wanted someone to help,(I tried),
and I hope it makes you feel better.

thank you for your help. The developed easement is not the neighbors property, but a county easement owned by the county. The county commissioners let the neighbor build it, and it is a sloppy not even close to a county code road. every time i go to the commissioners, they just tell me they do not want to get involved, seems to me they got involved when they let him develope this county road. I can't even belive they let him do it. I guess anyone who has equipment can develope anthing they want to. It just doesn't seem right. thanks for your help anyway it is greatly appreciated
