court ordered counceling

What is the name of your state (only U.S. law)? IL

I met with an attorney and he recomended that I petition for court ordered counceling because I really do not want to get divorced. He wasn't clear if I would get it or not. My question is: if my husband and I were already in counceling, would a judge still order counceling? And if so, what kind of arguments could I make to ensure a judge would order counceling?

You're already in counseling and it's not keeping together. What makes you think that court ordered counseling would be any different?

Your stbx would simply argue that you already tried counseling and it didn't work.

I should really rephrase my question. My husband and I went thru five counceling sessions two months ago and then he stopped and asked for a divorce. I have been asking him to rethink and would really like to try counceling one more time because I realize what mistakes I was making while in counceling the first time.

But you may have answered my question. If my husband says we already tried, would that be enough for a judge to dismiss the idea of court ordered counseling.

Actually, what I was hoping to find somewhere is a set of legal guidelines or arguments for when court ordered counseling would be appropriate. But it seems like it is just up to the judge and perhaps every judge could interpret this differently.

I doubt if there are any legal guidelines. Basically, the judge will order it if he thinks it will help. If it's already been tried, what's the point?
