My brother was convicted in NY of his third DWI while his licensed was suspended for his 2nd DWI. He plead to a felony and has to attend court ordered "therapy" sessions twice a week. What happens if he misses these sessions. He also claims that it doesn't mean he can't drink anymore. I can't believe this is true. Please advise.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Drinking while in therapy is like doing fdrugs while in rehab. Stupid and not allowed.

As for what will happen -- program cancelled, harsher sentence. Bad news all around.

Thanks so much for your reply. I guess this is an indication of his continued denial of his drinking problem that he would try to make us believe that his continued drinking is no big deal. My next step would be to get him into a longer term rehab, as the thought of him getting a license again would be a crime in itself.
